1. About FokusPad

FokusPad is a note-taking application designed primarily for students.

The service provides features that may include creating and organizing notes and notebooks, using student templates, uploading images, sharing notes, and synchronizing content across supported devices for signed-in users.

FokusPad may change, add, remove, or improve features over time.

2. Using FokusPad

You may use FokusPad only in compliance with these Terms and applicable laws.

You are responsible for your use of the service and for the content you create, upload, store, or share through FokusPad.

You must not use FokusPad in a way that interferes with the service, harms other users, violates applicable law, or attempts to gain unauthorized access to systems, accounts, or data.

3. Guest Use

FokusPad may allow you to use certain features without creating an account.

When using guest mode, notes and related application data may be stored locally in your browser or device.

Guest data may not be synchronized across devices.

You are responsible for maintaining access to locally stored guest content. Clearing browser data, changing browsers or devices, using certain private browsing modes, or removing local application storage may result in permanent loss of guest content.

FokusPad cannot guarantee recovery of guest data that has been deleted from your browser or device.

4. Accounts

Some FokusPad features require an account.

When creating or using an account, you agree to provide accurate information and to keep your account credentials secure.

You are responsible for activity occurring through your account.

You should notify us if you believe your account has been accessed or used without authorization.

FokusPad may support authentication through third-party providers such as Google. Your use of those authentication services may also be subject to the provider's own terms and policies.

5. Your Content

You retain ownership of the notes, text, images, study material, and other content you create or upload to FokusPad.

Using FokusPad does not transfer ownership of your content to us.

You grant FokusPad a limited right to host, store, process, reproduce, and transmit your content only as reasonably necessary to operate, maintain, secure, and provide the service and the features you choose to use.

For example, we may need to store your notes to synchronize them or host an uploaded image so that it can appear inside your note.

You are responsible for ensuring that you have the necessary rights to content you upload or share.

6. Uploaded Images and Files

FokusPad may allow supported images or other files to be uploaded as part of your notes.

You must not upload content that:

• You do not have the right to use
• Violates applicable law
• Infringes another person's intellectual property or privacy rights
• Contains malicious code or is intended to compromise the service
• Is otherwise prohibited by these Terms

Some storage features may generate publicly accessible file URLs as part of the application's current architecture.

You should not upload highly sensitive or confidential material to a feature that makes the underlying file publicly accessible.

FokusPad may restrict file types, file sizes, storage usage, or upload functionality for security, reliability, or operational reasons.

7. Sharing Notes

FokusPad may allow you to generate a link for sharing a note.

You control whether you distribute that sharing link.

Anyone who obtains a valid sharing link may be able to access the content associated with it. You are responsible for reviewing the content of a note before sharing it and deciding who receives the link.

Do not include information in a shared note that you do not want recipients of the link to access.

FokusPad is not responsible for further distribution of content by someone with whom you have intentionally shared it.

8. Student Templates

FokusPad may provide ready-made templates for purposes such as class notes, assignments, and exam revision.

Templates are provided as organizational tools only.

They do not constitute academic, educational, professional, or institutional advice, and we do not guarantee that a template will satisfy the requirements of a particular school, university, instructor, course, assignment, or examination.

You are responsible for adapting templates to your own academic requirements.

9. Acceptable Use

You must not use FokusPad to:

• Violate applicable laws or regulations
• Infringe intellectual property or privacy rights
• Distribute malware or harmful code
• Attempt to access another user's account or private data without authorization
• Probe, scan, attack, or disrupt FokusPad infrastructure
• Circumvent security or access controls
• Abuse, overload, or intentionally interfere with the service
• Use automated systems in a manner that places unreasonable load on the service
• Use FokusPad for fraudulent, deceptive, or unlawful activities

We may take reasonable action to protect FokusPad, its infrastructure, and its users from abuse or security threats.

10. Intellectual Property

Except for user content, FokusPad and its associated software, branding, design, logos, website content, and other materials are owned by or licensed to FokusPad and are protected by applicable intellectual property laws.

These Terms do not grant you ownership of FokusPad's software, brand, or other proprietary materials.

You may not copy, sell, redistribute, reverse engineer, or exploit protected portions of FokusPad except where permitted by applicable law or with our permission.

Nothing in these Terms restricts rights you may have under applicable open-source licenses for third-party software used by FokusPad.

11. Free Service and Future Changes

FokusPad currently provides functionality that may be available without payment.

We do not guarantee that every current feature will always remain free, unchanged, or available indefinitely.

We may introduce, modify, limit, or discontinue features or plans in the future.

If paid functionality is introduced, applicable pricing and additional terms will be presented before you purchase that functionality.

We will not charge you for a paid feature without your authorization.

12. Service Availability

We aim to keep FokusPad available and reliable, but we do not guarantee uninterrupted or error-free operation.

The service may occasionally be unavailable because of:

• Maintenance
• Software updates
• Infrastructure failures
• Third-party service interruptions
• Security incidents
• Network problems
• Events outside our reasonable control

Features may also change or temporarily become unavailable as FokusPad develops.

You are responsible for maintaining copies of information that is especially important to you where appropriate.

13. Third-Party Services

FokusPad relies on third-party services and infrastructure to provide parts of the service.

These may include services such as Supabase, Vercel, Google authentication, and Google Analytics.

Your interaction with third-party services may also be governed by their respective terms and privacy policies.

We are not responsible for independent third-party services or for outages, changes, or actions outside our reasonable control.

14. Account Suspension or Termination

We may restrict, suspend, or terminate access to FokusPad when reasonably necessary, including where:

• These Terms are materially violated
• The service is being abused
• There is a security risk
• Use of the service may harm other users or our infrastructure
• We are required to do so by law

Where appropriate and reasonably possible, we may provide notice before taking action.

You may stop using FokusPad at any time.

15. Account and Data Deletion

Where account deletion functionality is available, you may use the controls provided by FokusPad.

You may also contact us at contact@fokuspad.com regarding an account or data deletion request.

Deletion may be subject to limited retention where reasonably necessary for legal obligations, security, fraud prevention, dispute resolution, or other legitimate operational purposes.

Guest data stored locally may generally be removed through FokusPad controls or your browser's site-data settings.

16. Educational Disclaimer

FokusPad is a productivity and note-taking tool.

We do not guarantee academic performance, grades, examination results, assignment outcomes, admission results, or any other educational outcome from using FokusPad.

Users remain responsible for their own academic work and for following the rules and requirements of their educational institution.

17. Disclaimer of Warranties

To the extent permitted by applicable law, FokusPad is provided on an “as is” and “as available” basis.

We do not guarantee that the service will always be available, completely secure, error-free, or suitable for every particular purpose.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded under applicable consumer protection law.

18. Limitation of Liability

To the extent permitted by applicable law, FokusPad and its operators will not be liable for indirect, incidental, special, consequential, or similar losses arising from your use of or inability to use the service.

This may include loss of data, loss of access, interruption of studies, or other losses resulting from service interruptions or use of the service.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

19. Privacy

Your use of FokusPad is also subject to our Privacy Policy.

The Privacy Policy explains how information may be collected, used, stored, and processed when you use FokusPad.

20. Changes to These Terms

We may update these Terms as FokusPad develops, our features change, or legal and operational requirements evolve.

When these Terms are updated, the “Last updated” date at the top of this page will be revised.

For material changes, we may provide additional notice through the website or application when appropriate.

Your continued use of FokusPad after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.

21. Governing Law

These Terms are governed by applicable law.

Depending on where you live, you may also have mandatory rights under local consumer protection or other laws that cannot be limited by these Terms.

Nothing in these Terms is intended to remove rights that applicable law requires you to have.
